Please read these terms and conditions prior to placing your order. By placing an order with Climair UK Ltd you agree to the terms and conditions stated.
Any reference to Climair/Company/Seller/We/Us shall mean Climair UK Ltd of 197 Days Lane, Sidcup, Kent, DA15 8JX, who sell or supply wind deflectors and other motoring accessories in the course of their trade or business.
Any reference to You/Buyer/Purchaser shall mean the person detailed on the sales invoice.
We are committed to protecting your privacy. We only use the information we collect about you lawfully (in accordance with the Data Protection Act 1998).
We collect information from you when you place an order with us and from any emails we receive. None of your details are or will ever be passed on or sold to any third party. The personal information which we hold will be held securely in accordance with the law. We process personal information for the purposes of:
- providing a better service
- processing orders
- providing you with information about products and services we offer (but only if you have optionally chosen to receive such information).
From time to time if you have selected to subscribe to our newsletter we may use your email address to send you details of offers/new products we think may be of interest to you. If you do not wish to receive this information in future, please reply by sending a blank email with the subject line "Unsubscribe" and we will remove you from our database immediately. Alternatively you may email us directly on info@climairuk.com.
Our online payment system is provided by Protx and uses a combination of established and innovative techniques to ensure the security and integrity of all sensitive data. Their internet facing web servers are certified by Verisign, this ensures that no third parties can impersonate Protx to obtain secure information. All data stored on Protx systems is held on encrypted and highly secured databases. Protx are regularly audited by Visa and MasterCard to ensure that their systems conform to the latest security standards.
These terms and conditions do not affect your statutory rights as a consumer. Transactions are governed by British Law and any dispute in transactions will be settled by British Law.
2. ORDERS
Orders placed via our online shop are mere offers to purchase
and shall not be accepted or binding upon us until confirmed
or acknowledged in writing by us by means of invoice or statement.
The automatically produced order confirmation email is purely
an acknowledgement that you have submitted your order and
allows you to check that you have entered all information
correctly.
We retain the right to cancel any order at any time. If payment has been made, we will provide a full refund immediately.
3. PAYMENT
We will not despatch goods or put goods on back order until
payment is received in full. Trade customers will have their own arrangements by prior agreement with Climair UK Ltd. Payment can be made by credit/debit
card, cheque or bank transfer. See our how to order page for further information.
4. PRICES
We do our utmost to keep all prices and information on this
web site up to date. However, occasionally information from
our suppliers can change at short notice, so we must reserve
the right to alter specifications and prices on the web site
at short notice. In the rare event that the price of an item
ordered through the on-line shop has changed we shall endeavour
to hold to the price shown at the time of ordering. However,
in cases where there is a substantial increase we shall contact
you to agree a new price before accepting payment. If you
do not wish to agree to the new price then we reserve the
right to withdraw from the transaction.
Very occasionally we can make a mistake in email or phone quotations. We reserve the right to correct these and will always inform you before proceeding with your order. We are not bound to the price quoted at time of ordering until you have received both the goods and an invoice.
5. VAT
Most prices on our website include VAT. Where VAT has not
been included it is clearly indicated. All price quotations
by phone or email also include VAT unless otherwise stated.
6. DELIVERIES
When we quote delivery times it is in "working days".
This means any day excluding Saturday, Sunday and public holidays.
We shall inform you immediately if we are informed of any
delay and will inform you of the new delivery date.
7. SHORTAGES & DAMAGE IN TRANSIT
Once you or the person receiving the goods on your behalf
has signed for them you have accepted that the goods are undamaged
and that everything on the invoice/packing slip has been received.
If goods are damaged and you inform us after signing for them
we may not be able to make a claim from the couriers. Please
inspect the goods as soon as possible after receipt and notify
us immediately if there is a problem. If the goods are obviously damaged please write this on the carrier's sheet and contact us immediately. If the packaging looks okay but you suspect the contents are damaged please sign the delivery as unchecked. Open the parcel straight away and contact us immediately if you have a problem. If it is likely that
you will not be the person signing for the goods (such as
deliveries to a work address) it is your responsibilty to
ensure that the person signing knows what they are doing.
8. RETURNS
Unwanted goods for return must be notified to us in writing
within 7 days of receipt. We reserve the right to refuse returns
if notified outwith this period. The cost of returning the
goods safely to us is your responsibility. We may not be able
to accept back non-faulty goods that have been supplied to
your specific order or damaged during transit or fitting.
Goods must be returned in a re-saleable condition. Some special
order items correctly supplied may not be returnable depending
on the manufacturer's policy on returns.
Where goods are alleged to be defective, the purchaser agrees to return such goods for inspection and report (without us replacing the said goods prior to such inspection). The purchaser also accepts that it is reasonable to inform us of any interruption, defect or other failure prior to contacting independent third parties or incurring expense and, in addition, to allow us to remedy the defect, failure or interruption.

9. WARRANTIES & GUARANTEES
All guarantees for products are provided entirely by the manufacturers/UK
importers and are subject to their terms and conditions. If
you wish to pursue a warranty claim we shall act on your behalf
and shall treat all claims as a matter of urgency. Please always contact our
sales office first to confirm. Goods returned under warranty
must be accompanied by a valid proof of purchase and must
be returned carriage paid. If a manufacturer decides that
a warranty claim is not valid then we will not be liable for
any compensation. We will not accept any liability for any
labour or associated costs involved in a warranty claim.
Parts modified or adapted by the purchaser will not be warranted by the manufacturer nor shall Climair UK Ltd be liable for any failures resulting subsequent to modification as a result of such modification.
10. LIMITATIONS UPON LIABILITY
We aim to ensure that all information on our web site is correct.
However, we cannot be responsible for the use of the information
given.
Advice given by Climair UK Ltd staff on the telephone or by email is based entirely upon information given by the purchaser with no inspection undertaken. As such, all advice given is indicative only and should be checked by the purchaser prior to order. Where advice is given after visual inspection by Climair UK Ltd staff such advice shall amount to an opinion only.
Goods are supplied only to correspond to the purpose for which goods of that kind are commonly supplied and not alternative uses to which they may be put. No liability for failure will be accepted by Climair UK Ltd for such alternative use, amendment or modification.
We always do our best to deliver goods within the timescale quoted at the time of ordering but sometimes there can be a delay which is outwith our control. As such, any dates we specify for the delivery of goods are approximate only and we shall not be liable for any losses, costs, damages, charges or expenses caused by any delay for delivery of the goods. (We strongly recommend that you do not make arrangements to have parts fitted until they have arrived. We will not be held responsible for any charges incurred if such arrangmenets have to be cancelled due to a delay in delivery.)
All goods are subject to availability. If we do not supply the goods for any reason your credit card will be refunded the full amount. Climair UK Ltd will not be responsible for compensating you for any other losses which you may suffer if we do not supply the goods.
Goods may not be compatible with vehicles which have been modified, adapted or altered. Where goods ordered by the Purchaser are not compatible by reason of modification, adaptation or alteration, we may accept such goods back into stock entirely at our discretion and will either issue a refund or credit to the purchaser except where goods are specifically ordered for the purchaser where no such refund or credit will operate.
Under no circumstances will Climair UK Ltd be held liable for any fitting charges incurred by the purchaser. It is the purchaser's responsibility to ensure he has the correct parts prior to fitting. This can be as simple as comparing shape and size of the new items with the parts to be removed from the car.
No liability is accepted by Climair UK Ltd where purchasers attempt to modify or install components where it is known or ought reasonably to be known to the purchaser that the part is incorrectly supplied or otherwise not in accordance with the order.
Climair UK Ltd will only be liable for direct loss up to a maximum total of the price of the product in respect of any claim1.
